Damascus Box offers handcrafted Damascene mosaic art — mosaic boxes, chess and backgammon sets, home décor and luxury bags — made by artisans in Damascus, Syria, and shipped to you from Berlin. These Terms of Service set out the agreement between you and Damascus Box when you browse our website or place an order.
By using our website or placing an order, you accept these terms. Please read them together with our Refund Policy, Shipping Policy and Privacy Policy, which form part of this agreement. If you do not agree with these terms, please do not use our website.
1. Who we are
Damascus Box is a registered small business (Kleingewerbe) in Germany, operated by Yazan Krayem, Gartenstr. 58, 13355 Berlin, Germany. You can reach us by email at info@damascusbox.com or by phone on +49 160 4574617. Our online store is hosted on the Shopify platform.
2. Consumer sales and your statutory rights
We sell primarily to consumers. Nothing in these terms limits or excludes the rights you have under mandatory German and EU consumer protection law, including your statutory rights of withdrawal and your rights in respect of faulty goods. Where any clause here conflicts with a mandatory consumer right, that right prevails.
3. Using our website
You confirm that you are of legal age to enter into a binding contract in your country, or that you have the consent of a parent or guardian. If you create an account, you are responsible for keeping your login details confidential and for activity carried out under your account. Any information you give us — email, billing and shipping details — must be accurate and current.
4. Our products and natural variation
Every Damascus Box piece is made by hand from natural woods such as walnut, beechwood, rosewood, lemon wood and eucalyptus, often with genuine mother of pearl. Because of this, no two pieces are identical. Grain, tone, colour depth, pattern alignment and the exact placement of inlay will differ slightly from the photographs and from other pieces of the same design. Small marks left by hand tools, gentle variation in polish and minor differences in dimensions are part of the character of handcrafted work.
This natural variation is not a defect and is not a valid ground for a complaint about quality. Screen settings can also affect how colours appear on your device. Genuine faults — damage in transit, structural defects, missing parts or hardware that does not work — are of course covered by our Refund Policy and by your statutory rights.
We may change product descriptions, adjust our range or discontinue items at any time, and we may limit order quantities where necessary.
5. Orders and when a contract is formed
Product listings on our website are an invitation to buy, not a binding offer. When you place an order you make an offer to purchase. Our automatic order confirmation email acknowledges receipt of that order; the contract between us is formed when we accept your order by dispatching the goods or by confirming dispatch to you.
We may decline an order — for example if an item is no longer available, if pricing or product information was clearly incorrect, or if we suspect fraud. If we decline an order after payment has been taken, we refund you in full without delay.
Cancellations and returns are handled under our Refund Policy, which also explains your statutory right of withdrawal.
6. Prices, payment and VAT
All prices are shown in the currency of your selected market and include no VAT. As a small business under the German small-business rule (Kleinunternehmerregelung, § 19 UStG), Damascus Box does not charge value added tax, and no VAT is shown or invoiced on our orders.
Prices exclude shipping, which is calculated and displayed at checkout in line with our Shipping Policy. For deliveries outside the European Union, import duties, customs charges and local taxes may apply on arrival; these are set by the destination country and are payable by you.
Prices, discounts and promotions may change at any time, but the price shown at checkout is the price that applies to your order. Promotions may carry their own conditions, which prevail where they differ from these terms. You agree to provide valid payment details and authorise us to charge the total shown at checkout.
7. Shipping and delivery
Orders ship from Berlin. Delivery times given on our website are estimates and are not guaranteed; carrier delays, customs processing and events outside our control can affect them. For consumer orders, the risk of loss or damage passes to you when the goods are handed to you or a person you nominate, not when they are handed to the carrier. 8. Intellectual property
The Damascus Box name, logo, product photography, videos, product descriptions, translations and website design belong to Damascus Box or to our licensors and are protected by copyright and trademark law. You may view and share our content for personal, non-commercial use. You may not copy, reproduce, republish or use our images or text for commercial purposes — including marketplace listings, advertising or resale — without our written permission. Other trademarks appearing on the site remain the property of their owners.
9. Acceptable use
You agree not to use our website for any unlawful purpose, to submit false information, to infringe the rights of others, to transmit malicious code, to scrape or harvest data, or to interfere with the security or operation of the site. We may suspend or close accounts that breach these terms.
10. Feedback and reviews
If you send us reviews, photographs, ideas or other feedback, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and publish that content in connection with our business. You confirm that the content is yours to share and does not infringe anyone else's rights. We may remove content that is unlawful, misleading or offensive.
11. Third-party services and links
Our website is hosted on Shopify and uses third-party services for payments, shipping and analytics. Our site may also link to third-party websites. We do not control those services or sites and are not responsible for their content, products or practices; your dealings with them are subject to their own terms. All sales made through our store are contracts between you and Damascus Box.
12. Liability
We are fully liable for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee. For slight negligence, we are liable only where we breach an obligation that is essential to the performance of the contract, and then only for foreseeable damage typical for this type of contract. All other liability is excluded. Nothing in this section limits your mandatory statutory rights as a consumer.
13. Errors and corrections
Occasionally information on our website may contain an error — an incorrect price, description or availability. We may correct such errors and, where an order was affected, cancel it and refund you in full. We are not obliged to update information on the site except as required by law.
14. Privacy
We handle personal data in accordance with the GDPR and our Privacy Policy, which explains what we collect, why, and what rights you have over your data.
15. Governing law and dispute resolution
These terms and any contract between us are governed by German law. If you are a consumer resident in the EU, you also keep the protection of the mandatory consumer laws of your country of residence. Where a place of jurisdiction may lawfully be agreed — for example with business customers — the courts of Berlin, Germany have jurisdiction.
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle). We are, however, always happy to resolve any issue with you directly — please contact us first and we will do our best to put things right.
16. Changes to these terms
We may update these terms from time to time, for example to reflect changes in our products, our operations or the law. The version published on this page at the time you place an order is the version that applies to that order. Please review this page when you shop with us again.
17. General
If any part of these terms is found to be invalid or unenforceable, the remaining provisions continue in full effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these terms without our written consent. Together with the policies linked above, these terms form the entire agreement between us regarding your use of our website and your purchases.
